Applies to a Customer who is a Consumer:
We are obliged to deliver goods free from defects. The statutory right law of responsibility for defects in sold goods (warranty for defects) is in force to the extent specified in Article 556 and Article 556 [1] -556 [3] and further of the Civil Code.
Complaints can be submitted:
- in writing to the address: BANACZEK Sp. z o.o. ul. Szkolna 33, 83-047 Pomlewo.
- via e-mail to the following address: info@proengines.eu.
- or using the contact form available on the Store website.
In the case of exercising the action on the warranty - if we deem it necessary to consider the complaint, you are obliged to deliver the defective goods to the above-mentioned postal address at our expense. If due to the nature of the Product or the method of its installation, to provide the Product by the Customer would be extremely difficult, the Customer is obliged to provide the product in the place where the Product is located. We shall respond immediately to the complaint, which is no later than 14 calendar days from the date of its submission.
The Seller is under warranty if the physical defect is found before the expiry of two years from the date of delivery of goods to the consumer. If the object of sale is a used movable item, the liability under the warranty is one year from the date of its issuance.
In the complaint, it is recommended to (1) provide information about the subject of the complaint, in particular, the type and date of the defect; (2) specify the request regarding the method of removing the defect (replacement of the good with a new one, repair of good, reduction of price, withdrawal from the contract - if the defect is significant); and (3) provide contact details of the complaining party - this will facilitate and accelerate the complaint handling process through the Store. The recommendations specified above are only in the form of non-binding guidelines and in no way affect the effectiveness of complaints submitted without taking into account the recommended information.
Applies to a Customer who is not a Consumer at the same time:
In the case of a Sales Contract concluded with a Customer who is not also a Consumer, pursuant to Article 558 § 1 of the Civil Code, the liability of the Online Store under the warranty for defects of the Goods is excluded. This exclusion is ineffective in the case of fraudulent concealment of a defect.
